particuli\u00e8re<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>vuln\u00e9rabilit\u00e9 r\u00e9sultant de leur situation \u00e9conomique, apparente ou connue de<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>son auteur, de leur patronyme, de leur lieu de r\u00e9sidence, de leur \u00e9tat de sant\u00e9,<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>de leur perte d&rsquo;autonomie, de leur handicap, de leurs caract\u00e9ristiques<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>g\u00e9n\u00e9tiques, de leurs moeurs, de leur orientation sexuelle, de leur identit\u00e9 de<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>genre, de leur \u00e2ge, de leurs opinions politiques, de leurs activit\u00e9s syndicales,<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>de leur qualit\u00e9 de lanceur d&rsquo;alerte, de facilitateur ou de personne en lien avec<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>un lanceur d&rsquo;alerte au sens, respectivement, du I de l&rsquo;article 6 et des <\/i><span class=\"s2\"><i>1\u00b0 et 2\u00b0<\/i><\/span><\/p><p class=\"p2\" style=\"text-align: center;\"><i>de l&rsquo;article 6-1 de la loi n\u00b0 2016-1691 du 9 d\u00e9cembre 2016 <\/i><span class=\"s3\"><i>relative \u00e0 la<\/i><\/span><\/p><p class=\"p3\" style=\"text-align: center;\"><i>transparence, \u00e0 la lutte contre la corruption et \u00e0 la modernisation de la vie<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>\u00e9conomique, de leur capacit\u00e9 \u00e0 s&rsquo;exprimer dans une langue autre que le<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>fran\u00e7ais, de leur appartenance ou de leur non-appartenance, vraie ou<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>suppos\u00e9e, \u00e0 une ethnie, une Nation, une pr\u00e9tendue race ou une religion<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>d\u00e9termin\u00e9e.<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>Constitue \u00e9galement une discrimination toute distinction op\u00e9r\u00e9e entre les<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>personnes morales sur le fondement de l&rsquo;origine, du sexe, de la situation de<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>famille, de la grossesse, de l&rsquo;apparence physique, de la particuli\u00e8re<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>vuln\u00e9rabilit\u00e9 r\u00e9sultant de la situation \u00e9conomique, apparente ou connue de<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>son auteur, du patronyme, du lieu de r\u00e9sidence, de l&rsquo;\u00e9tat de sant\u00e9, de la perte<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>d&rsquo;autonomie, du handicap, des caract\u00e9ristiques g\u00e9n\u00e9tiques, des moeurs, de<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>l&rsquo;orientation sexuelle, de l&rsquo;identit\u00e9 de genre, de l&rsquo;\u00e2ge, des opinions politiques,<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>des activit\u00e9s syndicales, de la qualit\u00e9 de lanceur d&rsquo;alerte, de facilitateur ou de<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>personne en lien avec un lanceur d&rsquo;alerte, au sens, respectivement, du I de<\/i><\/p><p class=\"p2\" style=\"text-align: center;\"><span class=\"s3\"><i>l&rsquo;article 6 et des <\/i><\/span><i>1\u00b0 et 2\u00b0 de l&rsquo;article 6-1 de la loi n\u00b0 2016-1691 du 9 d\u00e9cembre<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><span class=\"s2\"><i>2016 pr\u00e9cit\u00e9e<\/i><\/span><i>, de la capacit\u00e9 \u00e0 s&rsquo;exprimer dans une langue autre que le<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>fran\u00e7ais, de l&rsquo;appartenance ou de la non-appartenance, vraie ou suppos\u00e9e, \u00e0<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>une ethnie, une Nation, une pr\u00e9tendue race ou une religion d\u00e9termin\u00e9e des<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>membres ou de certains membres de ces personnes morales.<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>Conform\u00e9ment \u00e0 l\u2019article 18 de la loi n\u00b0 2022-401 du 21 mars 2022, ces<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>dispositions entrent en vigueur le premier jour du sixi\u00e8me mois suivant sa<\/i><\/p><p class=\"p3\" style=\"text-align: refuser d&#8217;embaucher, \u00e0 sanctionner ou \u00e0 licencier une personne ;<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>4\u00b0 A subordonner la fourniture d&rsquo;un bien ou d&rsquo;un service \u00e0 une condition<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>fond\u00e9e sur l&rsquo;un des \u00e9l\u00e9ments vis\u00e9s \u00e0 l&rsquo;article <\/i><span p\u00e9riode<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>de formation en entreprise \u00e0 une condition fond\u00e9e sur l&rsquo;un des \u00e9l\u00e9ments vis\u00e9s<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>\u00e0 l&rsquo;article 225-1 ou pr\u00e9vue aux articles 225-1-1 ou 225-1-2 ;<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>6\u00b0 A refuser d&rsquo;accepter une personne \u00e0 l&rsquo;un des stages vis\u00e9s par le 2\u00b0 de<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>l&rsquo;article <\/i><span class=\"s2\"><i>L. 412-8 <\/i><\/span><i>du code de la s\u00e9curit\u00e9 sociale.<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>Lorsque le refus discriminatoire pr\u00e9vu au 1\u00b0 est commis dans un lieu<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>accueillant du public ou aux fins d&rsquo;en interdire l&rsquo;acc\u00e8s, les peines sont port\u00e9es<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>\u00e0 cinq ans d&#8217;emprisonnement et \u00e0 75 000 euros d&rsquo;amende.<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>Versions Liens relatifs ne sont pas applicables :<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>1\u00b0 Aux discriminations fond\u00e9es sur l&rsquo;\u00e9tat de sant\u00e9, lorsqu&rsquo;elles consistent en<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>des op\u00e9rations ayant pour objet la pr\u00e9vention et la couverture du risque d\u00e9c\u00e8s,<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>des risques portant atteinte \u00e0 l&rsquo;int\u00e9grit\u00e9 physique de la personne ou des<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>risques d&rsquo;incapacit\u00e9 de travail ou d&rsquo;invalidit\u00e9. Toutefois, ces discriminations<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>sont punies des peines pr\u00e9vues \u00e0 l&rsquo;article pr\u00e9c\u00e9dent lorsqu&rsquo;elles se fondent<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>sur la prise en compte de tests g\u00e9n\u00e9tiques pr\u00e9dictifs ayant pour objet une<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>maladie qui n&rsquo;est pas encore d\u00e9clar\u00e9e ou une pr\u00e9disposition g\u00e9n\u00e9tique \u00e0 une<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>maladie ou qu&rsquo;elles se fondent sur la prise en compte des cons\u00e9quences sur<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>l&rsquo;\u00e9tat de sant\u00e9 d&rsquo;un pr\u00e9l\u00e8vement d&rsquo;organe tel que d\u00e9fini \u00e0 <\/i><span class=\"s2\"><i>l&rsquo;article L. 1231-1 du<\/i><\/span><\/p><p class=\"p3\" style=\"text-align: center;\"><span class=\"s2\"><i>code de la sant\u00e9 publique <\/i><\/span><i>ou de donn\u00e9es issues de techniques d&rsquo;imagerie<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>c\u00e9r\u00e9brale ;<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>2\u00b0 Aux discriminations fond\u00e9es sur l&rsquo;\u00e9tat de sant\u00e9 ou le handicap, lorsqu&rsquo;elles<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>consistent en un refus d&#8217;embauche ou un licenciement fond\u00e9 sur l&rsquo;inaptitude<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>m\u00e9dicalement constat\u00e9e soit dans le cadre du titre IV du livre II du code du<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>travail, soit dans le cadre des lois portant dispositions statutaires relatives \u00e0 la<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>fonction publique ;<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>3\u00b0 Aux discriminations fond\u00e9es, en mati\u00e8re d&#8217;embauche, sur un motif<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>mentionn\u00e9 \u00e0 l&rsquo;article <\/i><span class=\"s2\"><i>225-1 <\/i><\/span><i>du pr\u00e9sent code, lorsqu&rsquo;un tel motif constitue une<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>exigence professionnelle essentielle et d\u00e9terminante et pour autant que<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>l&rsquo;objectif soit l\u00e9gitime et l&rsquo;exigence proportionn\u00e9e ;<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>4\u00b0 Aux discriminations fond\u00e9es, en mati\u00e8re d&rsquo;acc\u00e8s aux biens et services, sur<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>le sexe lorsque cette discrimination est justifi\u00e9e par la protection des victimes<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>de violences \u00e0 caract\u00e8re sexuel, des consid\u00e9rations li\u00e9es au respect de la vie<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>priv\u00e9e et de la d\u00e9cence, la promotion de l&rsquo;\u00e9galit\u00e9 des sexes ou des int\u00e9r\u00eats<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>des hommes ou des femmes, la libert\u00e9 d&rsquo;association ou l&rsquo;organisation<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>d&rsquo;activit\u00e9s sportives ;<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>5\u00b0 Aux refus d&#8217;embauche fond\u00e9s sur la nationalit\u00e9 lorsqu&rsquo;ils r\u00e9sultent de<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>l&rsquo;application des dispositions statutaires relatives \u00e0 la fonction publique ;<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>6\u00b0 Aux discriminations li\u00e9es au lieu de r\u00e9sidence lorsque la personne charg\u00e9e<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>de la fourniture d&rsquo;un bien ou service se trouve en situation de danger<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>manifeste.<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>Les mesures prises en faveur des personnes r\u00e9sidant dans certaines zones<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>g\u00e9ographiques et visant \u00e0 favoriser l&rsquo;\u00e9galit\u00e9 de traitement ne constituent pas<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>une discrimination.<\/i><\/p><p class=\"p3\" style=\"text-align: center;\"><i>Versions Liens relatifs Informations pratiques<\/i><\/p><p class=\"p2\" style=\"text-align: center;\"><span class=\"s1\"><i>\u2022 <\/i><\/span><i>Article 225-3-1<\/i><\/p><p class=\"p2\" style=\"text-align: center;\"><i>Cr\u00e9ation Loi n\u00b02006-396 du 31 mars 2006 &#8211;
